Terms of Service
Article 1 (Purpose)
These Terms of Service (hereinafter "Terms") set forth the rights, obligations, responsibilities, and other necessary matters between MegaWave (hereinafter "Company") and its members in connection with the use of Charim and all related services (hereinafter "Service") provided by the Company.
Article 2 (Definitions)
- "Service" means the Charim application and all services related thereto provided by the Company.
- "User" means any member or non-member who agrees to these Terms and uses the Service.
- "Member" means a person who has entered into a service use agreement with the Company and has been granted a user account.
- "Account" means the email address or social login account set by the member and approved by the Company for the purpose of identifying the member and enabling use of the Service.
- "Post" means any and all information, including text, images, files, links, and comments, posted or registered by a member within the Service.
Article 3 (Publication and Amendment of Terms)
- These Terms apply to all users who wish to use the Service.
- The Company may amend these Terms to the extent permitted by applicable laws and regulations.
- When the Terms are amended, the Company shall notify users through in-app or website notices or by email at least 7 days before the effective date of the amended Terms. However, for changes that are unfavorable to users, notice shall be given at least 30 days in advance.
- If a member continues to use the Service without expressly refusing the amended Terms by the effective date, the member shall be deemed to have agreed to the amended Terms.
Article 4 (Membership Registration)
- Users apply for membership in accordance with the procedures established by the Company, and membership registration is completed upon the Company's acceptance.
- Membership registration is available via email registration or login through social accounts such as Apple or Google.
- The Company may refuse a membership application or subsequently terminate the use agreement in the following cases:
- When another person's information is misappropriated
- When the applicant is under 14 years of age
- When a user who was previously restricted from using the Service attempts to re-register
- When the application is made in violation of these Terms or applicable laws and regulations
- The Service is intended for users aged 14 and older.
Article 5 (Account Management)
- Members are responsible for managing their account information and must not allow third parties to use it.
- If a member becomes aware that their account information has been misappropriated or is being used by a third party, the member must notify the Company immediately.
- The Company is not responsible for account theft or negligent management resulting from the member's own fault.
Article 6 (Provision of Service)
- The Company provides the following services:
- Meal planning feature
- Diet plan creation and management feature
- Shopping list creation and management feature
- Other services additionally developed by the Company or provided to members through partnerships with other companies
- The Company may change all or part of the Service as necessary for quality improvement or operational and technical reasons.
- The Company may temporarily suspend the provision of the Service in the event of unavoidable circumstances such as maintenance, failures, network issues, or natural disasters.
Article 7 (User Obligations)
Users must not engage in any of the following activities:
- Registering false information
- Misappropriating another person's personal information
- Infringing on the rights of the Company or third parties
- Interfering with the normal operation of the Service
- Violating applicable laws and regulations or these Terms
- Any other activity contrary to the Company's operating policies
Article 8 (Company Obligations)
- The Company shall comply with applicable laws and these Terms and make every effort to provide the Service continuously and stably.
- The Company shall maintain a security system to protect users' personal information, and shall publicly disclose and comply with its Privacy Policy.
- If the Company acknowledges that an opinion or complaint raised by a user regarding the use of the Service is justified, it shall process it promptly.
Article 9 (Service Restriction and Suspension)
- If a user violates the obligations set forth in these Terms or interferes with the normal operation of the Service, the Company may progressively restrict the user's use of the Service, including issuing warnings, temporary suspensions, or permanent bans.
- The Company may restrict a member's use of the Service or terminate the use agreement if the member violates these Terms or applicable laws and regulations.
Article 10 (Withdrawal of Membership)
- Members may terminate their use agreement at any time through the withdrawal function within the Service.
- Upon withdrawal of membership, personal information other than information that must be retained pursuant to applicable laws shall be destroyed without delay.
Article 11 (Changes and Termination of Service)
- The Company may change or terminate all or part of the Service as necessary for business or technical reasons.
- If it is necessary to terminate the Service, the Company shall notify users through in-Service notices or individual notifications at least 30 days before the termination date.
Article 12 (Disclaimer)
- The Company shall not be held liable if it is unable to provide the Service due to natural disasters, war, suspension of services by telecommunications carriers, or other force majeure events.
- The Company shall not be held liable for service disruptions caused by the member's own fault.
- The Company shall not be held liable for disputes arising between a member and a third party through the Service. However, exceptions apply where liability is recognized under applicable laws.
